Temporary Rent Increase Moratorium Ordinance

On January 27, 2026, the City Council adopted Ordinance No. 2026-6206 temporarily freezing rent increases on certain residential rental units in the City.  This summary answers some basic questions about the ordinance.  This summary is intended as general guidance only and is not intended as legal advice.  The ordinance becomes effective on February 26, 2026.

Important Reminder:

This moratorium does not cancel rent obligations. Tenants must continue to pay rent as agreed in their lease.  Landlords retain the right to enforce lease terms and collect rent.

Additional Requirements for Just Cause Evictions for the Purpose of Permanently Removing a Unit from the Rental Market

The additional requirements are: 

  • An owner shall not withdraw from the rental market less than all of the rental units from a property. 
  • Notices of termination shall be given concurrently to all tenants, provided, however, that eviction dates stated in the notices may vary to coincide with the termination dates of leases or rental agreements of affected tenants. 
  • Property that has been withdrawn from the rental market pursuant to this Chapter may not be used for residential rent purposes for a period of 5 years following the date of the last tenant eviction.. 

The new restrictions shall apply to proceedings to terminate a tenancy or recover possession of a unit that has not been fully completed before February 26, 2026.  The ordinance does not change any preexisting requirements for just cause eviction under Santa Barbara Municipal Code Chapter 26.50
