Rent Stabilization Frequently Asked Questions

Body

How to Use this FAQ

The City of Santa Barbara’s Residential Rent Stabilization Ordinance (SBMC Chapter 26.90) and Residential Rental Registry (SBMC Chapter 26.100) create new rules for rents, rent increases, notices, and registration of rental units. This FAQ answers the questions the City expects to hear most often from property owners and tenants during the first year of the program.

Section numbers in parentheses, such as (SBMC § 26.90.040), show where to find the rule in the Santa Barbara Municipal Code.

Please note that this FAQ is general information, not legal advice. If anything in this FAQ differs from the Municipal Code, the Municipal Code controls. City staff can explain how the ordinance works but cannot give legal advice about a specific dispute. The City will adopt regulations with more detail on several topics, and this FAQ will be updated as they are adopted.

The Ten Most Common Questions: Quick Answers

1
When do the annual rent adjustment limits start?

January 1, 2027

2
How much can rent go up each year?

For covered units, by the Annual General Adjustment the City publishes each year: 60% of the change in the Consumer Price Index (CPI), and never more than 3%.

3
How often can rent go up?

Once in any 12-month period, with at least 30 days’ written notice.

4
Is my unit covered?

Most rental units built before February 1, 1995 are covered, except single-family homes and condominiums that can be sold separately and a few other types of housing.

5
What is “base rent”?

For tenants who moved in on or before December 16, 2025, it is the rent in effect on December 16, 2025. For later tenants, it is the rent set at move-in.

6
Do I have to register my rental unit?

Yes, every rental unit in the City must be registered, including units that are exempt from rent limits.

7
When is registration due?

For units covered by the Rent Stabilization Ordinance: April 1, 2027. Exempt units: October 1, 2027. If the registration form becomes available later, the deadline is 30 days after it becomes available.

8
Can owners raise rent when a tenant moves out?

Yes. After a lawful vacancy, the owner may set the new tenant’s starting rent, subject to State law. Future increases for that tenant are then limited

9
Can rent go up more than the annual limit?

Only if a hearing officer approves an owner’s petition for a fair return or for capital improvements.

10
What can a tenant do if they think they are being overcharged or repairs are not being made?

Tenants can reach out to the Rental Housing Mediation Program to support facilitating a conversation with the property owner to inform them of the City’s new guidelines or they can file a petition directly with the Rent Stabilization Program to request a rent reduction.
