Business Customers

SB 1383 Edible Food Recovery Law: requires commercial edible food generators to donate surplus edible food to food recovery organizations. 

Edible food generators are subject to 2 requirements: 

• Establish a written agreement with a food recovery organization or service. A list of food recovery agencies located in the County of Santa Barbara can be found here. The City can provide you with a written agreement template. 

• Record food donation activities including: 

  • A schedule of food donation deliveries or collections 

  • Quantity of food donated in pounds per month

  • Types of food donated 

Mandated Food Donors Include: 

• Supermarkets  

• Grocery Stores ≥ 10,000 sq. ft.  

• Food Service Providers  

• Food Distributors  

• Wholesale Food Vendors  

• Restaurant Facilities ≥ 5,000 sq. ft. or 250+ seats  

• Hotels with an On-Site Food Facility and 200+ Rooms  

• Health Facilities with an On-Site Food Facility and 100+ Beds  

• Large Venues & Events  

• State Agency Cafeterias ≥ 5,000 sq. ft. or 250+ seats  

• Local Education Agency with an On-Site Food Facility 

Foam Ban 

Beginning January 1, 2019, vendors and retailers are no longer permitted to distribute or sell foam food and beverage containers in the City of Santa Barbara. Exemptions apply. 

Plastic Straws, Stirrers, and Cutlery 

Beginning July 1st, 2019, food and beverage providers are no longer permitted to use, provide, or distribute plastic beverage straws and plastic stirrers to any person. Non-plastic alternative straws shall be provided only upon request. Plastic cutlery may only be provided to customers "upon request."  

Plastic Bags

Certain stores are prohibited from providing single-use plastic carryout bags to customers at the point of sale, and requires a 10-cent charge for each paper bag provided to customers.
